Terms of Use

These Terms of Use ("Terms") are an agreement between you and AX AI Ventures ("we", "us") governing your use of the etc. mobile app and this website. By creating an account or using the app, you accept these Terms. If you do not agree, do not use etc.

1. Use of the app

etc. gives you a licence to use the app for your own personal, non-commercial fitness tracking. You are responsible for the accuracy of what you log and for keeping your account credentials secure. You must be at least 13 years old to use etc.

2. Subscriptions and payments

etc. may offer a free tier and paid subscription plans. The current price and billing period are shown to you before you confirm any purchase. Paid subscriptions auto-renew at the end of each billing period unless you cancel. How billing, cancellation, and refunds work depends on where you got the app:

• Direct download (Android APK). Subscriptions are purchased and managed through Whop, our payment provider. You cancel your subscription — and request any refund — through Whop, under its terms. Cancellation stops the next renewal; you keep access until the end of the period you already paid for.
• Google Play or the Apple App Store. Where etc. is distributed through an app store, subscriptions are billed through your store account, and billing, renewal, cancellation, and refunds are handled by that store under its own policy (cancel from your store subscription settings).

We do not separately process card payments ourselves. If something went wrong with a charge, contact us and we will help where we can.

3. Acceptable use

You agree not to: reverse-engineer, resell, or redistribute the app; use it to break any law; attempt to access another person's account or data; or interfere with the service's operation or security. We may suspend accounts that abuse the service.

4. Disclaimer of warranties

etc. is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that any calorie estimate, macro figure, or other output is accurate or complete. AI-generated estimates are approximations.

6. Limitation of liability

To the maximum extent permitted by law, AX AI Ventures is not liable for any indirect, incidental, or consequential damages, or for any health outcome, decision, or loss arising from your use of, or reliance on, the app or its estimates. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the 12 months before the claim.

7. Changes to these Terms

We may update these Terms. We will change the date above and, for material changes, notify you in the app. Continued use after an update means you accept the revised Terms.
